I. GRANT OF LICENSE: THERMCAP hereby grants you a non-exclusive, non-transferable, non-assignable right, under the applicable THERMCAP copyrights, to use one copy of the SOFTWARE on only one computer at any one time. The SOFTWARE is considered in use on a computer when it is loaded into temporary memory or installed into permanent memory.

II. PROPRIETARY RIGHTS: The SOFTWARE is owned exclusively by THERMCAP or its licensors, and this license does not transfer any ownership of the SOFTWARE to the end user. The SOFTWARE is copyrighted and licensed, not sold. You may make one copy of the PROGRAM for backup purposes. You must reproduce the copyright notice(s) on such copy of the PROGRAM.

III. NON PERMITTED USES: You may not translate, reverse program, disassemble, decompile or otherwise reverse engineer the SOFTWARE. You may not copy, modify or merge copies of the SOFTWARE except as provided in this Agreement. You may not rent, lease, sell, sublicense, assign, distribute or otherwise transfer the SOFTWARE except as provided in this Agreement. IV. TERM AND TERMINATION You may terminate your license to the SOFTWARE at any time by destroying all of your copies of the SOFTWARE. In addition, THERMCAP may terminate your license to the SOFTWARE if you fail to comply with all the terms and conditions of this Agreement. Upon termination, you agree to destroy all of your copies of the SOFTWARE.

V. NO WARRANTY: THIS SOFTWARE IS LICENSED TO YOU "AS IS," AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THERMCAP DOES NOT WARRANT THAT THIS SOFTWARE DOES NOT INFRINGE ANY RIGHTS OF THIRD PARTIES.

VI. LIMITATION OF LIABILITY: In no event shall THERMCAP'S liability related to any of the SOFTWARE exceed the license fees, if any, actually paid by you for the SOFTWARE. THERMCAP shall not be liable for any damages whatsoever arising out of or related to the use of or inability to use the SOFTWARE, including but not limited to direct, indirect, special, incidental, or consequential damages. Conductor data has been collected from the manufacturers that are currently producing the conductors listed within the THERMCAP database. While every effort has been made to verify conductor specifications, THERMCAP does not guarantee the veracity of that data.

VII.COMPLIANCE WITH INSTRUCTIONS: By accepting this license you agree to comply with the minimum system settings and follow and perform all installation instructions.
